How one baccarat hand is settled
Player, banker, tie, and commission under one New Jersey baccarat rules text. Five percent is not every table.

This page explains one rules version of baccarat-punto banco: New Jersey Administrative Code sections 13:69F-3.1, 13:69F-3.2, and 13:69F-3.3, as reproduced by the Legal Information Institute and read on 19 October 2026. It applies to that text. It does not apply automatically to an online table, a no-commission shoe, or a table in Malaysia. 365cuci.de does not operate the game. If the rules printed on the table in front of you differ, those printed rules are the ones that settle the hand. Nothing here is a way to win.
The point count in this code
Section 13:69F-3.1 gives cards these values: a two through nine counts as its face value, a ten or a face card counts as zero, and an ace counts as one. The point count is a single digit from 0 to 9. If the cards add up to a two-digit number, the left digit is discarded. The code’s own examples are an ace, a two, and a four, which count as 7, and an ace, a two, and a nine, which total 12 and therefore count as 2.
The higher point count wins the comparison between the two hands. An equal point count is a tie. This page does not restate the drawing rules for a third card. Those rules decide which cards appear. Settlement below starts once the two final point counts are known.
Player, banker, and a tie on the main bets
Section 13:69F-3.2 allows a wager on the banker’s hand, a wager on the player’s hand, and a separate tie bet. On the two main wagers, the higher point count wins and the lower loses. If the point counts are equal, both main wagers are void. Void here means the main stake is not won and not lost under this code. It does not mean the separate tie bet has won. That bet wins only when the point counts are equal, and it loses when they are not.
Section 13:69F-3.3(a) pays a winning player-hand wager at 1 to 1. There is no commission on that wager in this subsection. A worked example, using 100 units only as arithmetic and not as a suggested stake: a winning player wager of 100 units is paid 100 units of winnings. The stake is still the player’s. Profit is 100 units.
A winning banker wager is also paid at 1 to 1, except where a variant below says otherwise, and the operator then takes a commission called vigorish from the amount won. Subsection (c) lets the operator choose either 4 percent or 5 percent of the amount won. It does not fix every table at 5 percent. The same percentage applies to all players at that table, and an increase has to be notified under the cross-reference in subsection (d).
Using the 5 percent option on a winning banker wager whose amount won is 100 units: 5 percent of 100 is 5. Profit after that commission is 95 units. Using the 4 percent option on the same 100 units won, the commission is 4 and the profit is 96. If the amount won is 1 US dollar and the 5 percent option is in force, 5 percent is 5 cents. The same subsection allows that 5 percent figure to be rounded to 25 cents or the next higher multiple of 25 cents. That rounding rule is written in US currency for this New Jersey text. Do not copy it onto a table that states a different currency or a different commission.
On a tie, the code makes the main player and banker wagers void. They are not paid as wins, and the win/lose clauses do not call them losses. A separate tie bet is different. Subsection (b) says a winning tie bet is paid at odds of at least 8 to 1. “At least” means this code sets a floor, not a single price for every casino. At that floor, a winning tie bet of 100 units is paid 800 units of winnings. Another table, or another rules version, can pay a different tie price or can decline that side bet.
Variants inside the same code
Five percent is not the uniform rule even inside this subchapter. Subsection (e) allows a winning banker wager to be paid at 1 to 1 with no vigorish, if the operator chooses one of two options. One of those options pays a winning banker hand with a point count of six at 1 to 2 instead. On a 100-unit stake, 1 to 2 pays 50 units of winnings and no commission. The other option ties the no-commission price to separate total-card wagers. Those side wagers are optional in the code, and this page does not set out their pay table.
Subsection (h) allows another no-commission variation: vigorish is not collected, but a three-card banker hand with a point count of seven, called a dragon 7 hand, is a push. Section 13:69F-3.2(a)6 then makes the banker wager void on that dragon 7 hand. The code calls that result a push and void. It does not call it a win.
Section 13:69F-3.2(d) says no wager may be made, increased, or withdrawn after the dealer has announced “No more bets.” That closes the betting for the round. It is not a prediction of the next hand.
Questions about this rules version
Is every baccarat table a 5 percent banker commission?
No. In this New Jersey text the operator may take 4 percent or 5 percent, and two published variations take no vigorish and change the banker result instead. A table you open may use none of these options.
If the hands tie, does the banker bet win?
Not in section 13:69F-3.2. Both main wagers are void. Only a separate tie bet wins, and only if that bet was placed.
Where is the wider live-table checklist?
On the live-table guide. That page compares several table games with slots. It does not calculate this hand.
